Three Islands Press EULA FOR TYPEKIT MARKETPLACE v2018.01.22
The Three Islands Press End-User License Agreement (“The EULA”) for Adobe Typekit Marketplace (“The Marketplace”) is a binding contract between you (“The Licensee”) and Brian Willson, d.b.a., Three Islands Press (“3IP”), upon The Licensee’s purchase of any license(s) to 3IP font(s) (“The Software”) via The Marketplace. Please read The EULA entirely, as by installing and using The Software, you are wholly confirming that you understand and agree to the following terms: 1. End-User Licensing The Licensee agrees that The Software was created, is owned, and will be maintained by 3IP, and that its installation and use is governed by The EULA, not by Adobe. In no way shall the terms of The EULA conflict with, override, or nullify the Adobe General Terms of Use, as outlined here: https://www.adobe.com/legal/terms.html 2. Grant of License 3IP grants The Licensee a non-exclusive license (“The License”) for use of The Software provided via The Marketplace, in accordance with its terms of use. Moreover, The License is non-transferrable-unless allowed by jurisdictional law, in which case no transfers will be recognized unless The Licensee notifies the Adobe Typekit Service. 3. Maintenance & Support 3IP expressly agrees to provide The Licensee with full maintenance and support of The Software, and the Licensee is welcome to contact 3IP for said support. Under this agreement, Adobe’s obligation is limited to maintenance and support to customers of the Typekit Service, including delivery and font management. 4. Warranty While 3IP has taken great pains to apply high standards of quality in creation of The Software, and agrees to offer support to The Licensee and/or troubleshoot The Software, 3IP makes no warranty, express or implied, that The Software will prove suitable for The Licensee’s purposes. In no way is 3IP liable for any property damage, personal injury, or loss of income or profits through use of The Software; however, should The Software fail to conform to any applicable warranty contained herein, Adobe has the option to refund the purchase price of The Software. 5. Product Claims 3IP-not Adobe-is solely responsible for any third-party claims associated with The Software. 6. Legal Compliance The Licensee warrants and assures that The Licensee is not located in any country or territory subject to any legal embargo or other restriction, and is not a restricted party. 7. Privacy 3IP is committed to privacy and asserts that it shall not reveal or share any personal identifying information of The Licensee or any other party in any way associated with The License, directly or indirectly, and will comply with all applicable privacy-protection regulations, as well as in accordance with our internal Privacy Policy.
