1. DEFINITIONS

1.1 “EULA” means The End User license Agreement. 1.2 “Dharma Type” means Ryoichi Tsunekawa dba Dharma Type, #103 2-33-2 Kurumada-cho, Showa-ku Nagoya-shi, Aichi-ken, 466-0001 Japan. 1.3 “Adobe” means Adobe US, Adobe Systems Incorporated, a corporation organized under the laws of Ireland and an affiliate and licensee of Adobe Systems Incorporated. 1.4 “Font Software” means the fonts or font families that Dharma Type licenses to you for your use pursuant to this End User License Agreement. 1.5 “Typekit Service” means the Typekit Service website accessible from typekit.com, and all other services, features, or content made available to you on and through the Typekit Service. 1.6 “Typekit Marketplace” means the portion of the Typekit Service which Adobe offers for direct sale Font Software.

1. END USER LICENSE This End User License Agreement(EULA) is a legally binding contract between you and Dharma Type. This EULA covers use of the Font software exclusively within the Typekit Service. By installing or using the Font Software, you agree to be bound by the terms of this EULA. Please read all of this EULA carefully before you proceed.

2.1 Font Software Your use of the Font Software is governed by this EULA. You acknowledge this EULA is solely between Dharma Type and you and not with Adobe. Dharma type, and not Adobe, is solely responsible for the Font Software.

2.2 Typekit Service Your use of the Typekit Service is governed by Adobe Typekit Term of Service.

2.3 Precedence In relation to your use of the Font Software in the Typekit Marketplace, if there is any conflict between the terms of this EULA and the Adobe Typekit Terms, this EULA governs. In relation to your use of the Typekit Service, if there is any conflict between the terms of this EULA and the Adobe Typekit Terms, the Adobe Typekit Terms govern.

1. GRANT OF LICENSE Dharma Type grants to you a non-exclusive, non-transferable(except in jurisdictions where the law provides a right of transfer), limited right to access the Font Software provided to you in the Typekit Marketplace and to use the Font Software on and through the Typekit Service. The Font Software is licensed, and not sold, to you under this EULA. You have no ownership rights in the Font Software.

2. INTELLECTUAL PROPERTY RIGHT The Font Software is copyrighted and contain proprietary information and trade secrets belonging to Dharma Type. You may be held legally responsible for any infringement of Dharma Type’s intellectual property rights that is caused or encouraged by your failure to abide by the terms of this EULA.

3. MAINTENANCE AND SUPPORT If you find an error in the Font Software, you are first asked to contact Dharma Type at info@dharmatype.com. Dharma Type will attempt to fix the error. Dharma Type is solely responsible for providing any maintenance and support services with respect to the Font Software. You agree that Adobe has no obligation to provide any maintenance and support services with respect to the Font Software. Dharma Type cannot provide a refund directly, but you may contact Adobe.

4. WARRANTY If you find an error in the Font Software, you are first asked to contact Dharma Type at info@dharmatype.com. If the error is a result of a technical failure of the Font Software and it is not possible for Dharma Type to fix the error, you may notify Adobe, and Adobe may, at its discretion, refund the purchase price for the licensed Font software to you. To the maximum extent permitted by law, Adobe will have no other warranty obligation whatsoever with respect to the licensed Font Software. Dharma Type is not responsible for any problems that may arise from the use of the Font Software, such as computer malfunctions, idle time, shortfall of production, waste of material and any other direct, indirect, incidental or consequential damages that are caused by Dharma Type’s Font Software.

5. INDEMNITY You agree to indemnify and hold Dharma Type harmless from and against all claims, damage, losses and expenses of any kind (including reasonable legal fees and costs) that may result from your use of the Font Software or your breach of this EULA.

6. PRODUCT CLAIMS You acknowledge that in the event of any third party claim that the Font Software or your possession and use of the Font Software infringes a third party’s intellectual property rights, Dharma Type, not Adobe, will be solely responsible for the investigation, defense, settlement and discharge of any such claim.

7. LEGAL COMPLIANCE You must represent and warrant that (i) You are not located in a country that is subject to U.S. government embargo, or that has been designated by the U.S. government as a “terrorist supporting” country, and (ii) You are not listed on any U.S. government list of restricted parties.

8. PRIVACY Dharma Type’s use of any personal information that identifies or can be used to directly or indirectly identify an individual will comply fully with any applicable local and international privacy protection regulations, data protection regulations and other applicable laws, and will be used in accordance with the Dharma Type’s privacy policy.

9. NO WAIVER No waiver by Dharma Type of any breach or default under this EULA shall be deemed a continuing waiver or a waiver of any other breach or default, and any failure by Dharma Type to enforce any right or seek to remedy any breach under this EULA shall not constitute a waiver of such rights.

10. GOVERNING LAW This EULA will be governed by the laws in force in Japan.
