(I) End User Licensing. The end user must acknowledge that the EULA is governed by TipoType, not with Adobe. TipoType, and not Adobe, is solely responsible for the Licensed Font Software. (II) License Grant. The license granted to the end user for the Licensed Font Software must be limited to a non-transferable license to use the Licensed Font Software on and through the Typekit Service according to the terms of use. Transferring the license to third party’s is prohibited unless the law of the jurisdiction allows it. (III) Maintenance and Support. TipoType is solely responsible for providing any maintenance and support services with respect to the Licensed Font Software, as specified in the EULA, or as required by applicable law. TipoType and the end user must acknowledge that Adobe has no obligation to provide any maintenance and support services with respect to the Licensed Font Software. (IV) Warranty. TipoType is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Font Software to conform to any applicable warranty, the end user may notify Adobe, and Adobe may, at its discretion, refund the purchase price for the Licensed Font Software to the end-user. To the maximum extent permitted by law, Adobe will have no other warranty obligation whatsoever with respect to the Licensed Font Software. (V) Product Claims. TipoType and the end user must acknowledge that, in the event of any third party claim that the Licensed Font Software or the end user’s possession and use of the Licensed Font Software infringes a third party’s intellectual property rights, TipoType, not Adobe, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim. (VI) Legal Compliance. The end user must represent and warrant that (i) he or she is not located in a country that is subject to U.S. government embargo, or that has been designated by the U.S. government as a “terrorist supporting” country, and (ii) he or she is not listed on any U.S. government list of restricted parties. (VII) Licensor Name and Address. TipoType: info@tipotype.com, Av. Rivera 2898 Bis, apt. 701, 11300, Montevideo, Uruguay. (VIII) Privacy. TipoType’s use of any personal information that identifies or can be used to directly or indirectly identify an individual will comply fully with any applicable local and international privacy protection regulations, data protection regulations and other applicable laws, and will be used in accordance with TipoType’s privacy policy. (IX) Intellectual Property. The Licensed Font Software is intellectual property of the font’s respective designer, represented herein by TipoType, that owns the rights for distribution and reserves all rights to intellectual property. (X) Acknowledgments. High quality typeface design entails a large amount of work, time and energy, TipoType thanks you for your support by licensing font software.
